In a proposed rule published February 28, 2003 the U.S. Department of Health & Human Services (HHS), which oversees the Food & Drug Administration (FDA), is asking for public comment regarding the safety of ephedra and the potential addition of warning labels to products containing the herb. Significantly, and here is where you come in, the FDA is also asking what additional legislative authority it might need to effectively address this issue. What is troubling is that any change in FDA's legislative authority would be the result of amending the Dietary Supplement Health and Education Act (DSHEA), which is the law under which supplements are regulated, and apply to the entire supplement category - not just ephedra. The end result could be a return to the days when, at the very least, label information was more limited than it is today under DSHEA regulations, and could result in loss of choice in your own health care decisions by limiting access to supplements. BACKGROUND Millions of consumers, possibly you among them, contacted Congress in 1993/94 urging support for the regulatory framework, the Dietary Supplement Health & Education Act (DSHEA) in order to provide important health information and products to consumers and to ensure the safety of these products. The unanimous passage of the law reflected the overwhelming number of constituents – citizens like you -- demanding access to nutritional supplements. As a result, Congress unanimously passed DSHEA, which is a good law and gives the FDA all the power it needs to ensure safe and effective products when enforced. This recent action is just one of the many efforts underway to undermine DSHEA and limit consumer's health choices. It's imperative that consumers - every person concerned about access to a wide variety of safe and beneficial supplements - go on the record with the FDA within the next 14 days as supporting the Dietary Supplement Health and Education Act.
